At Pay Any Bill Now (“PABN,” “we,” or “us”), we honor your privacy preferences and ensure that your personally identifiable information (“PII”) is safeguarded when you engage with us. We seek to earn your trust through our commitment to transparency, security, putting you in control of your privacy choices, and using PII for no other purpose than as communicated to you. Your PII is used internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. We may also share some PII with third parties, but only as described below.

Other Websites and Businesses

This Privacy Policy covers the privacy practices of PABN only. This Privacy Policy does not apply to the practices of third-party websites, services, or applications, including third parties with which we partner. These third-party services are governed by their own privacy policies. PABN is not responsible for the privacy policies and practices of these third parties.

It is wholly your decision to share your PII with PABN. Your use of PABN is at all times subject to the Terms of Service , which incorporates this Policy. Please read this Privacy Policy and make sure that you fully understand and agree to it. By using our websites, the PABN financial operating platform (“PABN”), and any related products or services, you are agreeing to this Privacy Policy. If you do not agree to this Policy, please discontinue using our Services.

This Privacy Policy will explain:

1. What information does PABN collect?

When you sign up for PABN, we are required by federal law to collect “nonpublic PII” to verify your identity.

1.1 INFORMATION YOU PROVIDE

You may provide PII such as your name, email address, phone number, and hashed password when you use our Services, create a user account, or contact us. If you choose to make any payments via our Services, you may also provide us with your payment information and preferences, as well as information about any parties receiving payment. Payment information can include bank routing number, credit card number(s), phone number, permanent address, bank account number, bank account credentials, debit card number(s), and your social security number.

1.2 INFORMATION WE COLLECT AUTOMATICALLY

Cookies & Tracking Technologies
When you visit, interact with, or use our Services, we may collect certain technical data about you. We collect or generate such data either independently or with the help of third-party services, including through the use of “cookies” and other tracking technologies. A cookie is a text file that our website transfers to your device’s hard drive for record-keeping purposes and to enhance the quality of your visit to our website. Such data consists of sensor, location, connectivity, and technical and aggregated usage data, such as your GPS/GNSS location data; home and work locations; IP addresses, wireless networks, cell towers and Wi-Fi access points; non-identifying data regarding a device, operating system, and browser; activity, communication, and performance logs; issues and bugs; and user activity on our Services. Social Media
Depending on how you decide to use our Service and Website, we may also collect your social media identifiers. You can control what information you share through some social media networking sites’ privacy settings.

Please keep in mind that any information you share through such social media sites is visible to all participants on these social media sites, so you should never post any sensitive information (such as account numbers) to social media sites. Please carefully review the terms of use and privacy policies of these social media sites as they may be different from our own policies.

Customer Service-Related Information
We may collect additional information from or about you when you contact our customer support teams or respond to a survey. Customer service calls may be recorded for quality assurance purposes, identity verification, and, when appropriate, fraud detection.

1.3 INFORMATION FROM THIRD PARTIES

We may receive information about you from third parties. For example, we may receive information about you from outside records of third parties, such as marketing-related or demographic information, merchants, data providers, banks, brokers, and credit bureaus where provided by law. By using PABN, you direct these entities to share all such information with us.

Pursuant to this Policy, you direct the Issuing Bank to share your transactional data with PABN. You direct PABN to share your data with its users, vendors, partners, and affiliates at its discretion (subject to this Privacy Policy) in a way that may otherwise be contrary to such Issuing Bank’s stated and disclosed privacy policy.

2. How does PABN use the information it collects about me?

We use your PII as necessary for the performance of our Services and for complying with applicable law. Based on our legitimate interests in maintaining and improving our Services and offerings, we seek to understand how our Services are used and how to optimize our marketing, customer service and support operations; and protecting and securing our users, ourselves, and members of the general public.
Specifically, we use PII for the following purposes:

  • To authenticate the identity of our users and to allow them to access and use our Services;
  • To contact our users with general or personalized service-related messages (such as password-retrieval);
  • To target promotional messages (such as newsletters, special offers, new features, etc.);
  • To provide you with interest-based advertising about products and services tailored to your individual interests. (See How do we use cookies? below);
  • To facilitate, sponsor, and offer certain events and promotions;
  • To support and enhance our data security measures, including for the purposes of preventing and mitigating the risks of fraud, error, or any illegal or prohibited activity;

  • To enforce our Terms of Service and any other agreements between you and PABN;

3. How do we use Cookies?

We use these technologies to personalize PABN for you, optimize your user experience on our website(s), and to collect information about usage of PABN. Cookies also support the integrity of our registration process and retain your preferences and account settings.

To provide you with interest-based advertising about products and services tailored to your individual interests, we and certain third parties collect certain online activity. As a result, you may see our ads on other websites or mobile apps because we participate in advertising networks, which help us track the effectiveness of our marketing efforts and understand if you have seen one of our advertisements. These third parties may place or recognize a unique cookie or other technology on your browser (including the use of pixel tags). Where required by applicable law, we will obtain your consent prior to processing of your information.

4. Does PABN ever disclose Personal Data or other information?

4.1 PROVIDING INFORMATION TO THIRD PARTIES

When you sign up for PABN, you are directing PABN to share PII with third parties as outlined in this Policy. The PII that PABN shares includes both the PII that PABN collects from you directly and the PII that PABN collects from third parties.

4.2 BUSINESS AND LEGAL PURPOSES

We may provide your PII to Third Parties for business and legal purposes including for the purposes of:

  • Providing and improving PABN and/or marketing PABN and third-party products and services to you, as described above;
  • Providing PII to Third Party Providers as and to the extent described in the Terms of Service ;
  • Meeting the requirements of any applicable law, regulation, or legal process including complying with orders from courts of law, regulatory agencies, and law enforcement;
  • Investigating fraud inside and outside of PABN;
  • Broader business dealings such as mergers, asset sales, financings, and acquisitions (note: if we or our assets are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, your information could be one of the assets transferred to or acquired by a third party) (See section 8.3 under Privacy Rights); and
  • Reporting to credit bureaus.
4.3 LIMITATIONS ON PROMOTIONAL AND MARKETING USE

For the third-party promotional and marketing purposes outlined directly above, PABN will never share bank account or routing number, bank account username, password, business tax identification number, or your social security number unless you direct us to do so.

4.4 RESERVED RIGHTS

We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with the law or court order; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of Company, our employees, our users, or others.

5. How does PABN secure collected data?

5.1 OUR SECURITY PRECAUTIONS

We have implemented policies and procedures that are designed to protect both your confidentiality and the security of your nonpublic PII. We store and process your PII using bank-grade security to protect your PII. Additionally, PABN uses firewalls and data encryption, where reasonable. We also enforce restrictions on physical access to our office and files and limit digital access to sensitive data in order to ensure that only those employees who require the access to fulfill their job responsibilities actually have it.

5.2 NOTIFICATION OF SECURITY BREACH

Despite PABN’s efforts to keep your information secure, we cannot guarantee the security of your information. As a result, we strongly encourage you to take action to protect your PII and any device you use to access PABN. In the unlikely event that we come to learn that either our system or your account specifically has suffered a security breach, we may attempt to notify you so that you can take appropriate protective steps by email, text message, phone call, a notice on the PABN website, or any other way, depending on the requirements of applicable law.

5.3 LINKS TO OTHER SITES

We are not responsible for the privacy practices of any third parties or the content of sites that are linked from PABN, and we strongly encourage you to read the applicable privacy policies and terms and conditions of such parties or websites.

6. How long does PABN hold my Personal Data?

PABN will retain your PII to fulfill our legal and regulatory obligations and also for business purposes. We may retain your PII for longer than required by law if there is a legitimate business need for us to do so, and such retention is not prohibited by law. Should you close your account, PABN will mask your PII and non-PII but will retain and have access to this data as long as required to comply with applicable law and regulation. We will continue to use and disclose such PII in accordance with these Terms.

7. What are my Choices?

We want to communicate with you in the most effective manner, whether by sending you relevant marketing materials or by operating an intuitive and informative website. At the same time, we appreciate that your preferences regarding marketing, promotions, and online privacy will continue to evolve. This section provides you with information on how you can fine-tune your preference settings.

7.1 USE OF YOUR PERSONAL INFORMATION

We may use your PII to provide you with marketing or other promotional communications via mail or email. If, at any time, you would like to stop receiving these promotional emails, you may follow the opt-out instructions contained in any such email or by contacting us. Please note that by opting out, you may prohibit PABN from informing you of offerings that may be of interest to you. It may take up to ten (10) business days for us to process opt-out requests.

7.2 PABN MAY COLLECT INFORMATION REGARDING YOUR LOCATION

You may be able to prevent this collection through your device operating system settings. Similarly, you may be able to control how your browser interacts with cookies. However, if you remove stored cookies or block them from being set, you may affect the availability and functionality of PABN. In addition, we may use your PII to send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off on your device.

7.3 UPDATING YOUR INFORMATION

If you are a registered user of our Services, you may update and correct your information and delete inaccuracies through your account. Specifically, you can review and edit specific types of information at any time by logging in to the Website or the Services and making changes.

7.4 CORRECTING INFORMATION FROM THIRD PARTIES

PABN may receive from its customers PII about third parties (notably, payees) and may have no direct relationship with the individuals to whom that information relates. An individual who is not a PABN-registered user who seeks to access, correct, amend, or delete data provided to us by our customers should direct those requests to the customer as they will have access to that information through their own account. If requested to remove data, we will respond within a reasonable timeframe.

7.5 OPTING OUT OF THIS POLICY

As stated above, your usage of the PABN is contingent on your expressly opting into this Privacy Policy. If you change your mind after agreeing and wish to opt-out at a later date, you must contact us to delete or deactivate your PABN Account. You can do so by sending an email to contact@PayAnyBillNow.com. We are required by law to retain some of your information and may also do so for legitimate business purposes (e.g., internal analytics).

8. What are my Privacy Rights?

PABN is a U.S.-based company headquartered in California. Both California and U.S. law govern the information we collect. By accessing or using PABN or otherwise providing information to us, you consent to the processing and transfer of PII in and to the U.S.

8.1 YOUR CALIFORNIA PRIVACY RIGHTS

California law provides California residents the right to request from PABN: (i) a list of the categories of PII that we have disclosed to third parties for direct marketing purposes; and (ii) the names and addresses of all such third parties. If you would like to request this information, please email your request to contact@PayAnyBillNows.com. In your request, please specify that you want a copy of “Your PABN California Privacy Rights Notice.” Please allow thirty (30) days for a response.

8.2 A NOTE ABOUT PERSONAL INFORMATION FROM CHILDREN

No one under the age of eighteen (18) may use PABN’s Website or Service. Our Services are not directed to children under 13 years of age, and we do not knowingly collect information from children under 13. If we become aware that a child under 13 has provided us with PII, we will prohibit and block such use and will make all efforts to promptly delete any PII stored with us with regard to such child.

8.3 IN THE EVENT OF A CORPORATE ACTION SUCH AS A MERGER OR ASSET SALE

Should PABN merge with another business or should a substantial portion of PABN be purchased by a third party, or even if PABN files for bankruptcy protection, it is possible that your PII and non-PII about you will be transferred to any such successor entity in connection with a corporate action. Customer information submitted prior to such a corporate event would remain subject to the terms of this Notice. However, after such a corporate action, any information submitted by Customers would be subject to any new Notice and/or Privacy Policy adopted by a successor entity.

9. How are updates to this Policy handled?

From time to time, we may update our Privacy Policy. When changes are made, we will update the effective date at the top of this document, which will serve as your notice that the Policy has changed. If we make a substantial change to the Policy, we will send you an email notification, update our website, or provide you an alert to your mobile device or computer, or both. If you choose to continue using PABN’s products and services after receiving such notification, you are agreeing to the revised Privacy Policy.
